Effective Date: August 26th, 2026

These Affiliate Program Terms (“Terms”) govern participation in the OOAK Market Affiliate Program operated by OOAK Market (“we,” “us,” or “the Platform”). By joining the Program or using an affiliate link, you agree to these Terms.

1. Eligibility

Anyone 18 years or older may apply. We reserve the right to approve or reject any application at our sole discretion.

2. How Referrals Work

You will receive a unique referral link tracked through Toppal. A referral is credited to you only when the following conditions are met:

Referring an Artist

• The artist must create an account using your referral link, and
• The artist must list at least one product, and
• You earn commission only when that specific referred artist makes a sale.

Simply getting an artist to sign up (with no listings or sales) generates $0 in commission.

Referring a Buyer

• The buyer must complete a purchase using your referral link.

Attribution lasts for 90 days from the date the referred person first qualifies (first sale for artists / first purchase for buyers).

3. Commission Structure

You earn 2% of the gross sale value (before taxes and shipping) on every completed, non-refunded order that is properly attributed to your referral within the 90-day window.

• For artists: 2% is paid only on sales made by the referred artist.
• For buyers: 2% is paid on purchases made by the referred buyer.

4. Milestone Bonus

If the total gross sales attributed to your referrals reach $750 within the 90-day window, you will receive an additional $50 bonus.

5. Payouts

• Commissions and bonuses are calculated on completed, non-refunded orders only.
• A 14–30 day hold period applies after each sale to account for refunds and chargebacks.
• Payouts are made via the method available in your Toppal / affiliate dashboard (typically Stripe or PayPal).
• Minimum payout threshold: $25 (or as shown in your dashboard).
• We may withhold or reverse commissions for fraudulent, self-referred, or cancelled orders.

6. Restrictions

You may not:

• Refer yourself or create fake accounts
• Use spam, paid ads that bid on “OOAK Market” brand terms, or misleading claims
• Offer cash-back, coupons, or incentives that violate our main Terms of Service
• Engage in any activity that harms the Platform or its users

Violation may result in immediate termination and forfeiture of unpaid commissions.

7. Relationship of Parties

You are an independent contractor. Nothing in these Terms creates an employment, partnership, or joint-venture relationship. You are solely responsible for any taxes on commissions earned.

8. Changes & Termination

We may modify these Terms or the Program at any time. Continued participation after notice constitutes acceptance. Either party may terminate participation at any time. Upon termination, only commissions already earned and approved will be paid.

9. Limitation of Liability

Our total liability under these Terms is limited to the commissions actually owed to you. We are not liable for indirect, incidental, or consequential damages.

10. Governing Law

These Terms are governed by the laws of Arizona, USA. Any disputes will be resolved in the courts of Yavapai County.

By participating in the OOAK Market Affiliate Program, you confirm that you have read, understood, and agree to these Terms.
