1. Acceptance of Terms

  • By accessing or using OOAKMarket, you agree to be bound by these Terms of Service. If you do not agree, you may not use the platform.

2. Platform Overview

  • OOAKMarket is a curated online marketplace that connects independent artisans offering one-of-a-kind and limited-edition handmade goods with buyers and retailers.

3. User Accounts

  • You must be at least 18 years of age to use this platform.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate, current, and complete information during registration and listing creation.

4. Artisan (Seller) Obligations

  • You represent and warrant that all listings you create are accurate and that you have the legal right to sell the items.
  • You are solely responsible for the fulfillment, shipping, and quality of the goods you offer.
  • OOAKMarket charges a commission of 12% on each completed sale.

5. Buyer Obligations

  • All purchases are made directly from the selling artisan. OOAKMarket acts solely as a platform and is not a party to the transaction between buyer and seller.

6. Payments

  • All payments are processed through Stripe. By using the platform, you agree to Stripe’s terms and conditions.

7. Prohibited Conduct You agree not to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Engage in fraudulent or deceptive activity
  • Harass, threaten, or intimidate other users

8. Intellectual Property

  • Artisans retain ownership of their creations and listings. By posting content on OOAKMarket, you grant us a non-exclusive, royalty-free license to display and promote your listings.

9. Limitation of Liability

  • To the fullest extent permitted by law, OOAKMarket shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform.

10. Modifications

  • We reserve the right to modify these Terms at any time. Continued use of the platform after changes constitutes acceptance of the revised Terms.

Boutique / Wholesale Buyer Addendum

In addition to the general Terms of Service above, Boutique accounts agree to the following:

  • You represent that you are operating a legitimate retail or commercial business.
  • Wholesale pricing is provided exclusively for the purpose of resale in your store or business.
  • You agree to provide a valid Tax ID, Resale Certificate, or other proof of business status upon request.
  • Misuse of wholesale pricing (including personal purchases or unauthorized distribution) may result in account suspension and potential legal action.
  • OOAKMarket reserves the right to verify your business status at any time.

By registering as a Boutique or accessing wholesale pricing, you agree to both the general Terms of Service and this Addendum.
